These Terms of Service ("Terms") govern your access to and use of the software, automation, and AI communication services (the "Services") provided by PPG Holdings LLC, doing business as AI EXPERT — Real Estate Automation ("AI Expert," "we," "us," or "our"). By signing up for or using the Services, you agree to these Terms.
1. The Services
AI Expert provides a hosted CRM, automation workflows, and AI-powered voice and messaging tools for real estate investors. Features vary by plan and may be added, changed, or removed over time.
2. Subscriptions, Free Trial & Billing
- 14-day free trial. Eligible new accounts include a 14-day free trial. You provide a payment method at signup, and you are not charged during the trial.
- Recurring billing. After the trial, your plan (e.g., $147/month for the Pro/Founding plan) renews automatically each month to your payment method until you cancel.
- Cancellation. You may cancel at any time; cancellation stops future renewals. Access continues through the end of the current paid period.
- Refunds. Except where required by law, monthly subscription fees are non-refundable once a billing period begins. If you cancel during the free trial, you will not be charged.
- Price changes. We may change pricing on prospective renewals with reasonable notice. Founding-rate commitments, where offered, are honored as described at signup.
3. Your Responsibilities & Acceptable Use
You are responsible for your use of the Services and for all activity in your account, including messages, calls, and campaigns you send to your own contacts. You agree that you will:
- Comply with all applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM, state telemarketing and do-not-call rules, and carrier/messaging (A2P 10DLC) requirements.
- Obtain and maintain any consent required to call or text the contacts you load into or generate through the Services, and promptly honor opt-out (STOP) requests.
- Not use the Services for unlawful, deceptive, harassing, or abusive purposes.
You are the sender of your own outreach. AI Expert provides the tools; you are solely responsible for the content of and consent for your communications with your contacts.
4. AI Communications
Some features use automated and AI-generated voice and text. You are responsible for reviewing and configuring these features (including scripts and disclosures) for your use case and for compliance in your jurisdiction.
5. No Guarantee of Results
The Services are tools to support your business. We do not guarantee any specific number of leads, appointments, deals, or income. Results depend on your market, effort, and execution.
6. Intellectual Property
We own the Services, software, and related content. We grant you a limited, non-exclusive, non-transferable right to use the Services during your subscription. You retain ownership of your own data and content.
7. Third-Party Services
The Services rely on third-party providers (e.g., telephony, AI voice, payment processing, and CRM platforms). Your use may also be subject to their terms, and we are not responsible for third-party services.
8. Suspension & Termination
We may suspend or terminate access for non-payment, violation of these Terms, or activity that creates legal or carrier-compliance risk. You may stop using the Services at any time by canceling your subscription.
9. Disclaimers & Limitation of Liability
The Services are provided "as is" and "as available" without warranties of any kind. To the maximum extent permitted by law, AI Expert will not be liable for indirect, incidental, or consequential damages, and our total liability for any claim will not exceed the amounts you paid us in the three (3) months before the claim.
10. Indemnification
You agree to indemnify and hold AI Expert harmless from claims arising out of your use of the Services, your communications with your contacts, or your violation of these Terms or applicable law.
11. Governing Law
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-laws rules. Venue for any dispute lies in the state or federal courts located in Georgia.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated date, and continued use of the Services constitutes acceptance.
